Federal government responds to Virginia's lawsuit over health care
The federal government has responded to Atty. General Ken Cuccinelli's office regarding the lawsuit filed by Virginia concerning the health care bill.
They made a motion to dismiss it. No surprise there.

“We are still looking through the motion and 39-page brief that we received late Monday, but at initial glance, this is pretty close to what we expected."The federal government's reasons for dismissing the lawsuit included:
- that as of matter of jurisdiction and procedure, Virginia has no right to bring this case now;The AG has until June 7 to respond, and the federal government has until June 22 to reply.
- that Congress has the authority under the Constitution’s Commerce Clause to order Americans to buy health insurance;
- that the health insurance mandate is lawful under the taxing power of Congress.

“The federal government is forcing citizens to buy health insurance, claiming it has the authority to do so because of its power to regulate interstate commerce via the Constitution’s Commerce Clause. We contend that if a person decides not to buy health insurance, that person – by definition – is not engaging in commerce, and should not be subject to a federal mandate,” said Cuccinelli.NOTE: AUDIO and VIDEO clips from the attorney general’s announcement will be available online Tuesday at 8:30 am EDT for download at http://www.vaag.com/PRESS_RELEASES/index.html. Cuccinelli argued, “Just being alive is not interstate commerce. If it were, there would be no limit to the Commerce Clause and to Congress’s authority to regulate everything we do. If Congress has the power to force Americans to buy health insurance, then there’s nothing to stop Congress from forcing us to buy any product.”
In March, Virginia enacted the Virginia Health Care Freedom Act, which provides that the government cannot require Virginians to buy health insurance. It was passed by an overwhelming bipartisan majority in the General Assembly (90 to 3 in the House and 25 to 15 in the Senate), and had the support of Governor Bob McDonnell.
The federal health care law, with its insurance mandate, creates a conflict of laws between the federal government and Virginia. Since the attorney general of Virginia has a duty to defend validly enacted Virginia laws from any challenge, he filed suit in federal court seeking a declaration that the Virginia Health Care Freedom Act is constitutional and that Congress exceeded its constitutional authority by imposing the individual mandate.
The U.S. Constitution’s Supremacy Clause usually allows federal law to trump state law. But if a federal law is found unconstitutional while a conflicting state law is found constitutional, the state law will prevail.
The attorney general has offered support in the form of shared research to the other 19 states suing over the health care bill in Florida, but Virginia has not joined that case because of the direct conflict between Virginia’s law and the federal law. Virginia has chosen to defend a Virginia statute in a federal court in Virginia.
The other duties of the attorney general’s office will continue as normal during this case. No attorneys have been taken off any other sections, such as public safety, consumer protection, or Medicaid fraud, to work on this lawsuit.
The case is the Commonwealth of Virginia v. Kathleen Sebelius. It is in the U.S. District Court for the Eastern District of Virginia in Richmond.

WSJ: "No, you can't keep your health plan"
Dr. Scott Gottlieb opines in today's Wall Street Journal about ObamaCare, the health profession, and how Barack Obama and the Democrats have misled Americans about the status of their personal insurance. Barack Obama said in no uncertain terms that Americans could keep their insurance:
President Obama guaranteed Americans that after health reform became law they could keep their insurance plans and their doctors.Dr. Gottlieb, a former official at the Centers for Medicare and Medicaid Services and who is a fellow at the American Enterprise Institute and a practicing internist, points out that is not true:
It's clear that this promise cannot be kept. Insurers and physicians are already reshaping their businesses as a result of Mr. Obama's plan.The truth slowly creeps out from the 2,000 page bill that was hurriedly passed by partisan Democrats on a protesting public. Will Republicans be able to turn it around once they are back in control in DC?
The health-reform law caps how much insurers can spend on expenses and take for profits. Starting next year, health plans will have a regulated "floor" on their medical-loss ratios, which is the amount of revenue they spend on medical claims. Insurers can only spend 20% of their premiums on running their plans if they offer policies directly to consumers or to small employers. The spending cap is 15% for policies sold to large employers.

Insurance agent warns Rush about ObamaCare
If you want to learn about a subject, talk with someone well-versed in that subject. Listening to conservative talk radio offers that opportunity for millions of Americans, and ObamaCare is no differnt.
On Rush Limbaugh's Tuesday show, an insurance agent called with the dismal news of what ObamaCare will do to America. A friend alerted me to this since I was out and about and missed much of the show.
This insurance agent warns that insurance agencies may be able to hang on for two or three years before going out of business, due to the new mandated government-enforced health care forced on America. Be sure to read the interview and listen to the audio.

My grandmother used to say, "If it's good for the goose, it's good for the gander." Seems that would be true of mandatory health care that was forced on Americans, and the exemption of Barack Obama, Congress, and staffers.
If we have to swallow this bitter pill, so should they.

Health care: Do not despair ... this is not 1935
Neil Stevens at Red State hit the nail on the head: This time it's different:
And word of fraud spreads quickly. All the back room deals will eventually come out ... the millions (billions?) of dollars spent to buy Democrat votes. Republicans have been left out in the cold. Taxpayers have been mugged.
Americans are on top of this issue which is why it took Congress so long to pass an issue they thought would be finished a year ago.
And while many were blue on Sunday, watching the Democrat steam roller crush Americans, they rebounded on Monday determined to continue the fight which will, as noted by Mr. Stevens, take place a mere nine months from now when a conservative tsunami sweeps over the country, removing Democrats from office.
Will the legacy of Barack Obama, Nancy Pelosi, and Harry Reid be that they passed health care reform ... or will it be that they began the destruction of the Democrat Party?
Time will tell.

Obamacare: Passed in 2010. Republicans take House in 2011, one year (9 months, actually) later?
There’s just no comparison. We can fight back before much of it even takes effect, not over a decade later when the benefits are entrenched. No excuses. No pessimism. Fight and win, politically.

Most colonists thought they would have to buy the tax stamps even though they were unhappy with it ... until that Virginia patriot Patrick Henry came out with the Tax Act Resolves saying no taxes would be paid unless passed by the House of Burgesses. "Virginia Governor Fauquier did not approve of the resolutions, and he dissolved the House of Burgesses in response to their passage." Sound familiar? Thanks to DJ for the reminder that, "If you break it, you own it." Democrats will break health care in America, the best in the world (and that is why they all come to us) ... so now Democrats own it.

May we never forget that it was Barack Obama, Nancy Pelosi, Harry Reid, and the Democrat Party that forever destroyed American health care. They are all looking for legacies much as Roosevelt and the New Deal. To them, the Constitution be damn ... it's their way, not the American way.
But this is a different day and age. This is the computer age. No longer are people isolated in rural areas or in mountain hollows, away from communication with the outside world. News these days is instantaneous and scrutinized to the nth degree.

Right-to-life group revokes "Defender of Life" award to Stupak
This was an interesting tidbit picked up this morning on Greta Van Sustern's Greta Wire blog:

Susan B. Anthony List Candidate Fund President Marjorie Dannenfelser said the group was revoking its "Defender of Life" award to Stupak, which was to be awarded at its Wednesday night gala.A poll on Greta's site shows 94% agree with the decision to rescind the award to Congressman Stupak.
"We were planning to honor Congressman Stupak for his efforts to keep abortion-funding out of health care reform. We will no longer be doing so," Dannenfelser said. "Let me be clear: any representative, including Rep. Stupak, who votes for this health care bill can no longer call themselves 'pro-life.'"
Stupak, who led Democratic lawmakers opposed to the Senate bill, made an announcement of a deal Sunday afternoon, surrounded by a handful of Democratic lawmakers who had held out their "yes" votes in exchange for a guarantee of no public funding for abortion.
The arrangement appeared to cement passage of the massive insurance overhaul as House lawmakers later approved the rules for debate in a 224-206 vote, moving the House one step closer to passage. (preceding text from FoxNews.com)

Richmond, Va. – Americans for Prosperity Virginia Director Ben Marchi issued the following statement after the U.S. House passed the health care takeover bill:
"Tonight, 219 Democrats in the U.S. House of Representatives put blind adherence to a radical government-first ideology ahead of the wishes of the American people. Now, bureaucrats and politicians will stand between patients and doctors, and our health care will be permanently politicized, subject to the whim of an out of touch political class. They have defied the American people and the Constitution they are sworn to uphold by requiring citizens to purchase healthcare plans and threatening fines for those who fail to do so.
"As a result, we urge Attorney General Ken Cuccenelli to move immediately, through options available to him, to protect the sovereignty of the Commonwealth of Virginia and the rights of Virginia's citizens.
"For more than a year, Virginians have been making their voices heard on this important issue and in doing so, they have told Congress that they don't want a government takeover of healthcare. "Tonight, 219 Democrats in the U.S. House of Representatives put blind adherence to a radical government-first ideology ahead of the wishes of the American people. Now, bureaucrats and politicians will stand between patients and doctors, and our health care will be permanently politicized, subject to the whim of an out of touch political class. They have defied the American people and the Constitution they are sworn to uphold by requiring citizens to purchase healthcare plans and threatening fines for those who fail to do so.
"As a result, we urge Attorney General Ken Cuccenelli to move immediately, through options available to him, to protect the sovereignty of the Commonwealth of Virginia and the rights of Virginia's citizens.
"For more than a year, Virginians have been making their voices heard on this important issue and in doing so, they have told Congress that they don't want a government takeover of healthcare. AFP-VA held more than 80 rallies and town hall meetings that brought out more than 10,000 Virginians who told Congress to get their hands off our healthcare.
"We applaud the 34 Democrats who joined with House Republicans to offer bipartisan opposition to this bill that will kill Virginia jobs and increase our national debt. RPV Chairman Pat Mullins issued the following statement....
“Let me be perfectly clear. The action taken in Congress tonight will forever alter the size and scope of our Federal government. The legislation that the Obama/Pelosi Democrats forced on the American people tonight will bury our children, grandchildren, and great-grandchildren in mountains of debt," Mullins said. "Bureaucrats in Washington D.C. will now know better than you and your doctor what medical treatments you need. And our federal government will become more entwined with our daily lives than our founding fathers could have ever imagined."
“Ultimately, Congressmen Gerry Connolly and Tom Perriello cast the deciding votes on this legislation. They had the opportunity not once, but twice, to stand up and listen to their constituents, but each time they choose to stand with their party bosses," he said. "They had the power to stop this monstrosity, but they chose not to act.”
"While Congressmen Connolly and Perriello may have cast tonight’s decisive votes to allow for the federal takeover of our healthcare system, it was Senators Mark Warner and Jim Webb who cast the deciding votes in the Senate in the dead of night on Christmas Eve that made today’s legislative fiasco possible. Had either Senators Warner or Webb listened to the people of Virginia, we wouldn't be here tonight. They too will ultimately be held responsible for the actions that took place in Congress today.”

• Turned the IRS into the national health insurance police.
• Levied a huge unfunded mandate onto Virginia and other states that will either require tax increases or cuts to core services like education and public safety.
• Made it highly likely that dozens of states will pull out of the federal Medicaid program.
• Set the stage for either crippling levels of deficit spending, or the collapse of Medicare as we know it.
"Thousands of Virginians called their member of Congress, Senator Warner, and Senator Webb, emailed them, faxed them, attended town hall meetings, met privately with them, traveled to Washington D.C. and voiced their opposition to this legislation," he said. “For nearly a year now the American people have rejected the Democrats’ health care proposals. They have sent letters and e-mails, made phone calls, attended town hall meetings and come to Washington to rally at the Capitol. Their message has been simple and consistent: We don’t want a government takeover of our health care system.H.R. 3590, the Senate-passed health care legislation, passed the House of Representatives on Sunday, March 21, 2010, by a vote of 219-212.
"With complete and total disregard for the will of the American people, House Democrats pushed through their health care legislation, which is defined by federal regulations, mandates, a myriad of new big government programs, and a significant increase in federal spending and debt at a cost to our country too high to bear. This legislation, which I voted against, gives Washington bureaucrats ultimate control over what is best for you and your family – deciding when and what treatment you can receive.
"I know Americans are frustrated by rising health care costs, and that is why we in Congress must work in a bipartisan way to cut health insurance costs and make health care better, more available, and more affordable for all Americans. Unfortunately, the only thing bipartisan about the health care bill that passed the House tonight is the strong bipartisan opposition to the bill. It raises taxes, raises health care costs, adds to our national debt, and hurts America’s seniors, families and small businesses.
"Specifically, the Democrats’ health care bill includes $569 billion in new taxes and over a trillion dollars in new government spending. This includes $52 billion in new taxes on employers, including small businesses, that cannot afford to provide health coverage or that don’t offer coverage. The effect of this type of tax, similar to a payroll tax increase, would ultimately fall squarely on workers in the form of lower wages or reduced employment. Additionally, the legislation includes $17 billion in new taxes on Americans who do not comply with the individual insurance mandate which is sure to further stifle economic growth.
"Additionally, the Democrats’ health care bill includes $523 billion in Medicare cuts, including $200 billion in cuts to the popular Medicare Advantage program which will hurt millions of seniors.
"It’s your job to make health care decisions for your family. The government’s job is to ensure you have access to affordable alternatives and then get out of the way. That is why I strongly support the Republican alternative that would empower patients with choices, make high quality coverage more affordable, and protect and preserve the doctor-patient relationship.
Unlike the Democrats’ plan, the non-partisan Congressional Budget Office has confirmed that the plan offered by House Republicans will lower premiums by up to 10 percent and reduce the deficit by $68 billion over 10 years, all without imposing tax increases on families and small businesses and while improving the quality of your health care. It allows for the purchase of health insurance across state lines, allows individuals and small businesses to join large pools to get more competitive rates, provides tort reform to cut down the high cost of defensive medicine, allows full tax deductibility of health insurance premiums, portability of health insurance and protection against pre-existing condition exclusions.
This legislation, that I support, focuses on strategies that help Americans obtain the best quality health care at the least cost, and ensures that the government fosters increased access to quality care based on individual choice, not by taking away choices from people on the grounds that government knows best.”

Democrats dodging and weaving in debate on House floor
The discussion going on right now on the House floor shows the evasive measures used by Democrats to jam mandatory health care through at any cost.
Republicans have to stand up, demand, and use whatever parliamentary procedures are at their disposal as the minority Party.
Americans are angry that the House Democrats are moving forward against the will of their fellow countrymen. There's a mood in this country, an awakening awareness of the deceitful leadership from Democrats who have ignored transparency, worked behind closed doors, shut out CSPAN (even though Obama said everything would be debated in front of television cameras), and ignored the voices of 1.2 million Americans who marched on Washington, DC, on September 12, 2009, to say, "We do not want socialized health care."
House Minority Leader John Boehner (R-OH), just gave a rousing speed in front of the House and he received sustained applause from Republicans afterwards. "Have you read the bill?" he asked Democrats. "Hell, no, you haven't read the bill!"
House Majority Leader Nancy Pelosi is now passing on the propaganda of the Democrat Party, beginning by saying, "It is with humility and pride...." Isn't that an oxymoron? (Or maybe it's just a moron.)
Health care is a privilege. It is not a right. Why did I work jobs specifically that provided health care when I was young at a time when I would rather have wandered the mountains or painted on the beach? What shall we legislate next? That every family have a new car every year?
